Fabulous Jewelry of the Stars (FJS) reserves the right to modify, alter or otherwise update the terms of this agreement, and those using this site agree to be bound by such modification.

Purchases on this site may only be used by individuals and businesses who are able to form legally binding contracts. Purchases may not be made by minors or any person or entity otherwise legally incompetent.

Prices: All prices on this site are in U.S. dollars, and exclude any applicable shipping, handling, or insurance charges.

Taxes: The buyer is responsible for paying any and all applicable taxes on purchases from this site. FJS will charge appropriate sales or other taxes on your purchases to the extent required by state or local tax authorities.

Sales: All items on this site are sold “AS IS”. All sales are final and binding on the purchaser. As most items on this site are unique, FJS does not accept returns, give refunds, or apply credits, other than as indicated below. If you have any questions regarding an item you are interested in purchasing, please contact FJS by email before agreeing to purchase. Once a purchase is submitted to FJS you are responsible for full payment of the purchase of the item and any applicable taxes, shipping, or insurance charges.

Warranties: FJS guarantees that the description of the items on this site are accurate and reasonably describe the items and their condition. Should you believe that an item you have purchased is not as described, please notify FJS immediately. If FJS agrees, the full purchase price, including shipping and other charges, will be refunded in full upon the return of the item, provided the item is in the same condition as when purchased. FJS’s decision on this point is final. FJS warrants that items for sale on this site do not infringe upon any third party’s property rights, and will refund any monies paid for items proven to be otherwise.

FJS makes no other warranties of any kind, and expressly disclaims all implied warranties, including, but not limited to, the warranty of merchantability and fitness for a particular purpose.

Indemnification: Buyers agree to indemnify, defend and hold harmless FJS, its affiliates, officers, directors, owners, or other agents from and against all claims, liability, losses, costs, and expenses, legal or otherwise, incurred by any party in connection with any breach by the buyer of these Terms and Conditions, or misuse or misrepresentation of any item purchased on this site.

Risk of Loss: Buyers take title to items purchased at the time they leave FJS’ possession. Buyer assumes all risk of loss, or damage to, items in transit.

Delivery: FJS uses various carriers to deliver purchases. Time of delivery is controlled soley by the carrier, and FJS is unable to guarantee specific delivery dates for purchases. Purchases will be shipped within seven (7) business days from the date of verification of payment. In the event of missing shipments, FJS will assist as able in tracking those shipments, but the responsibility for delivery times remains solely with the carrier.

Privacy of Information: Information provided to FJS as part of your use of this site will be used by FJS only to process your order. FJS will not, without your permission, distribute, sell, or rent your name or information to any third party. FJS processes orders with secure access software, but does not guarantee that your information cannot be intercepted by third parties elsewhere on the Internet while in transmission to or from FJS.

Intellectual Property Rights: All information on this site, including text, graphics, photos, logos, icons, designs, and images, is the property of FJS and is protected by copyright and trademark laws. No reproduction, distribution, transmission, publication, or display of this site’s contents is allowed without prior written permission of FJS. All trademarks of third parties appearing on this site are for purposes of identification, and those trademarks remain the property of the holders of those trademarks.

Limitations of Remedies: Buyers agree that should a dispute arise between the purchaser and FJS concerning a purchase made, damages will be limited to the purchase price paid for the item, including shipping and other charges, and buyers expressly agree not to claim any individual, consequential, or punitive damages.

Governing Laws: This agreement shall be governed by and enforced in accordance with the laws of the State of Maryland, as it is applied to agreements entered into and to be performed with said state. Any action brought to enforce this agreement shall be brought only in either the state or federal courts located in Montgomery County, Maryland, and buyers expressly consent to the jurisdiction of said courts. If any provision of this agreement shall be unlawful, void, or unenforceable for any reason, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.

Compliance with Laws: In using this site, you agree to comply with any federal, state, or local laws, statutes, ordinances, and regulations which apply to this site and your purchases from FJS.

Notices: Notices about this site and this Agreement will be given by email to the address you provide to FJS as part of the purchase process. Notice will be deemed to have been received 24 hours after email is sent, unless the sending party receives notice that the email address used is invalid.

Waiver: If either party fails to enforce a term or condition of this Agreement in a specific instance, that failure does not constitute waiver of that party’s right to enforce this Agreement in full, or any term or condition thereof, in any subsequent breach or against any other party.

The terms of this Agreement form the understanding and agreement between both parties. This Agreement was last modified on January 10, 2001.
